The Southern Kaduna Peoples’ United Association (SOKAPU) has filed a lawsuit at the Federal High Court in Kaduna against the Minister of Works, David Umahi, over the June 27, 2026 death of nurse Mary Habila, Vanguard reported on Saturday, July 25, 2026.
According to the suit, Habila died while attached to the minister’s medical team, reportedly at Umahi’s residence. The circumstances of her death have drawn intense public scrutiny and calls for a full, independent investigation.
SOKAPU named as respondents Habila’s father, Tanko Wisdom; the Attorney-General of Ebonyi State; and the Commissioner of Police, Ebonyi State.
The association is asking the court to order an autopsy to determine the cause of death and is seeking N20 billion in damages from Minister Umahi, alleging a breach of duty of care while the nurse was under his custody.
Earlier, the Ebonyi State Police Command said an autopsy would be performed despite reported objections from some family members. Umahi has also written to the Ebonyi State Commissioner of Police urging that an autopsy be conducted to clarify the circumstances surrounding the death.
The case raises legal questions about duty of care, ministerial accountability, and the role of judicial and investigative procedures in establishing cause of death.
